Subject: 18688 Chg.Police Manual 1.08 VII Date: Thu, 17 May 1990 14:59:00 -0500 RESOLUTION NO. 18688 A RESOLUTION AUTHORIZING THE ADOPTION OF POLICE MANUAL ORDER 1.08 A7VII.A.6 RELATIVE TO RETIRED PERSONNEL CARRYING FIREARMS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Police Manual Order 1.08 A7VII.A.6 (a copy of which is attached hereto and incorporated herein by reference) be and is hereby adopted. ADOPTED: 6/19/90 PAN:cjc 6. Retired sworn personnel who meet the requirements set forth in T.C.A. A739-17-1315(a) and (b)(2) as described below are hereby authorized to carry a handgun as described in section VII.A.2. a. Retired officers shall, on an annual basis, successfully complete an eight (8) hour training program offered by the department. b. Prior to carrying any firearm, a retired officer shall obtain a written directive from the Chief of Police authorizing him to carry such handgun and shall furnish the Chief of Police with proof of liability insurance or bond prior to receiving such directive. The bond or liability insurance shall include the Chief of Police as an additional named insured on the face of the policy. The bond or liability insurance shall further contain language requiring the insurance company to notify the Chief of Police of any cancellation, expiration or revocation of the bond or insurance policy at least thirty (30) days prior to cancellation, expiration or revocation by the company. c. Prior to issuing the directive to the retired officer, the Chief of Police shall require the person to have in effect a liability policy in the amount of not less than that required by state law evidenced by a certificate of insurance made to the Chief of Police. The insurance must be for the specific purpose of carrying a firearm and must so state on the face of the policy. This requirement does not preclude insurance which by its nature provides coverage for this purpose as well as other general liability provisions. In lieu of liability insurance, the retired officer may make a corporate surety bond in the amount of not less than that required by state law for the above purpose, a copy of which must be provided to the Chief of Police by the bonding company. The failure to provide insurance or bond or the revocation or cancellation of any policy of insurance shall result in revocation of any written directive authorizing the retired officer to carry a firearm. A copy of any written directive shall be retained as a permanent record of the Chattanooga Police Department. d. The provisions herein relative to training and insurance/bond may be waived by the Chief of Police in those cases where the retired officer is already authorized to carry a firearm by the federal government or by the state government or a political subdivision thereof.
